Arkansas (The Gaslamp Post) – When seconds count, the police are just minutes away…  Police say a shoot out ensued in a Fort Smith apartment, yesterday morning.  A man’s apartment was entered through an unlocked door, at around 6:00 am, Tuesday, and it’s occupant was confronted by two men, one with a gun, according to NWAOnline.

Look mom, no brains! Justin Spencer, 25, reported shot several times while trying to rob a man in his own home.

The resident, 39-year-old Thomas Smith, told authorities that the man holding the gun had told him that he was there to rob him.  Smith asked the robbers if he could put his pants on, and then pulled a small handgun from his pocket and opened fire.  He is reported to have hit the armed man several times in the upper torso, but took a bullet in the shoulder.

The second man fled the apartment and is now at large.

The armed robber was able to escape the apartment but wound up at another nearby apartment, where he is said to have told the occupant that he was shot trying to buy drugs.  Police arrested the man, 25-year-old Justin Spencer, (pictured above) at the apartment and had taken him to the hospital for treatment of non-life threatening wounds.

Spencer was charged with felon in possession of a firearm.
